NATIONAL ENVIRONMENTAL POLICY ACT -WHAT IT IS AND WHY IT MATTERS TO PRACTITIONERS

The National Environmental Policy Act (“NEPA”)is a broad-ranging federal environmental statute that requires that all federal agencies take a“hard look” at the potential environmental consequences of any projects that are to receive federal funding or require federal approvals or permits. Most notably, it requires that federal agencies prepare an “Environmental Impact Statement” (“EIS”) prior to taking any “major federal action significantly affecting the quality” of the environment. Challenges to the failure to prepare an EIS and the inadequacy of an EIS issued in support of a federal permitting action have been made against energy projects ranging from coal mines to natural gas pipelines to wind farms.This presentation will help the energy practitioner be aware of this potentially substantial roadblock to development projects and become attuned to the types of problems that can lead to successful NEPA challenges.
