HIPAA FOR LITIGATORS AND THE CORRESPONDING CYBERSECURITY RISKS

Every day a new risk to cybersecurity is exposed. Lawyers, especially those in litigation, spend countless time with electronic data, including social media, medical records, or other client-sensitive documents. An increased ability to remotely access these documents only magnifies the risk. This session will provide guidance to lawyers who are subject to HIPAA by receiving medical records or other documents produced and stored electronically. This includes a brief background on HIPAA and the increased cyber risks. This session will also examine the guidelines for lawyers in advising providers on complying with HIPAA, and other federal and state laws, when asked to produce protected health information in response to pending litigation.
